These Terms & Conditions govern the use of the website and the services provided by Shaka Fuerte SL ("the Company", "we", "our", "us"). By booking lessons, courses, rentals, events, or purchasing services through our website or directly with the Company, you agree to these Terms & Conditions.

The Company provides, among others:

• Windsurf lessons
• Wingfoil lessons
• Kitesurf lessons
• Equipment rental
• Coaching services
• Guided sessions
• Events and clinics
• Sale of sports equipment and accessories

All services are subject to availability, weather conditions, and operational requirements.

3. Booking and Payment

Bookings may be made online, by email, by telephone, or in person. A booking is considered confirmed only after:

• Payment has been received; or
• A deposit has been paid where applicable; or
• Written confirmation has been issued by the Company.

The Company reserves the right to refuse or cancel bookings at its discretion. Prices are displayed in Euros (€) and include applicable taxes unless otherwise stated.

4. Participant Requirements

Participants confirm that:

• They are physically capable of participating in the selected activity.
• They do not suffer from any medical condition that would make participation unsafe.
• They will follow all instructions provided by instructors and staff.
• They will comply with local maritime and safety regulations.

Participants are responsible for informing the Company of any relevant medical condition, injury, allergy, disability, or limitation that could affect their participation.

5. Minors

Participants under the age of 18 must have authorization from a parent or legal guardian. The parent or legal guardian accepts these Terms & Conditions on behalf of the minor.

6. Weather Conditions

Watersports activities depend on weather and sea conditions. The Company reserves the right to:

• Modify lesson schedules;
• Change instructors;
• Change locations;
• Postpone activities;
• Cancel activities;

when weather, sea state, wind conditions, safety concerns, or operational circumstances make it necessary. The instructor's decision regarding safety conditions shall be final.

7. Cancellation and Refund Policy

Customer Cancellation

More than 48 hours before the activity:

• Full refund or rescheduling option.

Less than 48 hours before the activity:

• Refunds may be denied.
• Rescheduling may be offered at the Company's discretion.

No-shows are not entitled to a refund.

Company Cancellation

If the Company cancels due to weather, safety concerns, equipment failure, or operational reasons, participants may receive:

• A rescheduled session; or
• A refund of the unused portion of the service.

The Company shall not be responsible for additional expenses incurred by the participant, including accommodation, flights, transportation, or other indirect costs.

8. Equipment Rental

Customers renting equipment agree to:

• Use the equipment responsibly and according to its intended purpose.
• Inspect the equipment before use.
• Return equipment at the agreed time and in the same condition, allowing for normal wear and tear.
• Immediately report any damage, malfunction, loss, or accident.

The renter may be held financially responsible for damage resulting from negligence, misuse, reckless behaviour, theft, or failure to follow instructions.

9. Assumption of Risk

Watersports activities involve inherent risks that cannot be completely eliminated. These risks may include, but are not limited to:

• Falls
• Collisions
• Equipment failure
• Strong winds
• Waves and currents
• Contact with other participants
• Marine hazards
• Personal injury
• Property damage
• Serious injury or death

By participating, customers acknowledge and voluntarily accept these inherent risks.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for:

• Personal belongings lost, stolen, or damaged;
• Indirect or consequential losses;
• Delays or interruptions caused by weather or force majeure;
• Injuries resulting from failure to follow instructions or safety rules.

Nothing in these Terms excludes liability that cannot legally be excluded under Spanish law.

11. Insurance

The Company maintains any insurance coverage required by applicable Spanish law. Participants are encouraged to obtain their own travel, accident, medical, and sports insurance where appropriate.

12. Photography and Video

Photographs and video recordings may be taken during activities. The use of images for promotional or commercial purposes shall be subject to the participant's consent in accordance with the Company's Privacy Policy and applicable Spanish legislation. Participants who do not wish to appear in photographs or recordings should inform the Company before the activity begins.

13. Intellectual Property

All content available on this website, including text, logos, photographs, videos, graphics, and design elements, is owned by or licensed to the Company and is protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, or used without prior written authorization.

14. Force Majeure

The Company shall not be liable for any failure or delay resulting from circumstances beyond its reasonable control, including extreme weather conditions, natural disasters, government restrictions, public health emergencies, strikes, utility failures, and transportation disruptions.

15. Privacy and Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including the GDPR and Spanish Organic Law 3/2018 (LOPDGDD).

16. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the laws of Spain. Any dispute arising out of or relating to these Terms shall be submitted to the competent courts of Spain, without prejudice to any mandatory consumer protection rights that may apply.

Acceptance

By booking a lesson, rental, course, event, or any other service provided by Shaka Fuerte SL, the participant confirms that they have read, understood, and accepted these Terms & Conditions.
